If it is against the same property, same person and nature of the suit is same, then you cannot and what is the necessity of filing.

Under section 11 of CPC, the second suit is is barred if the suit is already decided on the same property, parties and on same issuer were involved in the earlier suit. Under section 10 attracts if the suit is still pending.

Sec. 9 is about jurisdiction, Sec. 10 CPC about stay of suit when 2 or more significantly identical suits pending in any court, recent suit 2b stayed.
