Hi, I wanted to know can a person become the secretary of cooperative society if he does not stay in the same society and has rented his flat ,as the secretary is not staying in the society the day to day affairs are not being looked after properly ,kindly guide me what are the possible options for resolving this issue ,as hes not willing to resign .Thanks

If there is no stipulation in the Society’s Rules and bye laws that the Secretary should stay inside the society premises and he should not let his flat on rent, he can do both.
The argument that the day-to-day affairs of the society could not be performed properly is a very weak proposition. It indicates some personal distaste of the querists towards the Secretary’s going home.
Even if he stays inside such inaction or lapses can occur. On the other hand, he can perform his duties properly without staying inside as well.
The only solution is to make it a binding rule in regard to both issues the querist has a complaint, or else make someone the Secretary.

It is neither mandatory nor compulsory that the Secretary must reside in the society complex.

The Secretary's wish to stay in the society or not. If he is not attending and unable to do his duties, then you may contact other Executive Members and appraise the matter and ask them to conduct a Special General Body Meeting for change of the Secretary. Even you are selected as Secretary or President you also cannot do duty with the satisfaction of entire members of the Society. Usually, some small incidents will be done naturally. If any executive member does not do duty properly, call for a GB meeting or complain to the Dy.Registrar/Registrar of Coop. Housing Societies of your district.

It's secretary's wish where he should reside or not to reside members of society have no right to make questions on this point. If secretary does not perform his duties or look day to day affairs then for solution of this issue general body may be called.
