Section 80 CPC

(Querist) 12 May 2010 This query is : Resolved 
Section 80 of the civil procedure code, 1908 says that if we have to file a case against the public officer or any state authority or to any state goverment or central goverment. we have to first give them a notice in writing but i am confused that where the 2 months time mentioned under the section is regarding the miscondut or breach done by the public authority or any state authority or to any state goverment or central goverment. or after giving the notice to the parties with 2 months. pls clarify the 2 months funda .

2) As usual posting the queries again pls answer .

What is the pecunilary limits of the follwing courts in any matters or any notes pls answer i do request.

District court, sub - ordinate court, bombay high court, supreme court, or to any appellate authority.

3) WHo do we come to know that the particular courts have who much pecunilary limits form where i will come to know.

2 months time to make govt., to rectify and correct their fault or do the needful.
Civil Judge ( junior Div) courts have got jurisdiction to entertain the suits up to 500,000/- and bare injunction suits.
Senior Division courts have got above500,000/- .. It has got jurisdiction ot hear the appeal filed against the j & D of the junior courts.
Dist., courts jurisdiction : Sessions cases, appeals against the Senior Divn., court j & D

If A has to recover x amount from the Government, he shall server a legal notice u/s 80 C.P.C to Government giving 2 months time to pay the x amount, failing which A can file a suit for recovery against Government.

Pecuniary Jurisdiction In State of Delhi

Sr. Civil Judge or civil judge : 3,00,000/-

District Judge or A.D.J : Above 3,00,000 to 20,00,000/-

High Court : Above 20,00,000/-
