certainly suit can be filed if nominal fee required by govt have been deposited and there should be expert opinion that patient died due to negligency of hospital staff and due to lack of necessary equipment which must be available in this hospital as per the govt rules. magisterial enquiry can also be asked for the negligency on the part of hospital.

Certainly it is negligence and suit lies. If a medical equipment like broken syringe needles can amount to negilgence, your case is a clear case of negilgence.
