This query is : Resolved
This query is with regard to the verification of a signature on a Will.
The signature of the testator and one of the witnesses are forged. The case relates to a Hindu family. What are the methods to verify these forged signature and from where it can be done ?
1)Whether the age of the paper and ink used on the Will can be ascertained by conducting forensic tests?
2)Whether a handwriting expert can verify the signature and his report be accepted in a court ?
3)By calling in a handwriting expert to verify the signature.
4)Would this be regarded as adequate proof under Sec 67 of the Indian Evidence Act?
5)If I possess other documents of the same person bearing the same signature, would that be enough to prove a signature under Sec 67?
Thanks

Yes the age of the paper and ink used on the Will can be ascertained by conducting forensic tests. Yes a handwriting expert can verify the signature and his report will be accepted in a court. Yes this is as adequate proof. Yes you produce other documents of the same person bearing the same signature, that would be enough to prove the signature.

First thing, Age of Ink or Age of Paper (Writing) tests are discontinued from India due its controversial results, as these results are not accurate and not acceptable in court of law or any other legal purpose, So these tests are discontinued by Govt. Labs as well as Private Labs. If you have any recent information you can contact them.
Second thing- Many experts in India provides report about Age of Ink or Age of Paper (Writing) tests and these tests are not accurate, but they claim that it is true on the basis of only visual eye testing OR Some experts performing some specific tests, but still there is controversy in these tests, (Many tests are not acceptable.)
Third- Some USA / UK Experts performs these tests, but these tests are very very expensive and may not be acceptable as primary evidences etc...
Yes, you can verify doubtful signatures with sample signatures from certified handwriting expert.
