Signature verification report

In the criminal case pending against my father, we have got signature verification report against us, from CFSL, GEQD. But we are not ready to believe that report because that person signed the documents in front of us, but as now he has managed this report against us, i am unable to understand what can be done to cancel this report. because anyhow we got to have the report done from some other laboratory but that too came against us. many officers told us that as the report is against u, no other lab will contradict the report easily, because all labs are of govt and are under one head.
can anyone help me out and tell what should we do to suppress that report and how ?

when you have doubt then you have to examine the expert by cross examining him. Except cross examination there is no other way.

Ms.Meenakshi Chauhan,
As per section 73 of the Evidence Act it is the prerogative of the presiding officer to himself/herself make a distinction or refer the matter for testing the authenticity by way of expert opinion. As it is evident there is no bar if you can adduce your evidence or nail the culprit as Mr.Rajeev has suggested by way of cross examination.

what i have seen in many judgments is that conviction can not be given only on the basis of signature report as this is just an opinion and may vary from expert to expert, court always demands corroborative evidences with the report. and in our case i dont find such evidences against us. only the report is there.

my experience,
contact recently retired officer of lab.who is expert in same technical matter ,if he is doing same private practice with registration, prefer him and get report from him and cross examination report of first report will help you and hon.court may permit you to do so .it may set aside first report or may neglect sign verifications if another corroborative proof are with you.

Expert report may be biased and it is not taken with much weight after analyzing other records in the file. I agree with Mr. Sanjay Mundada and follow his advise. The best principle in criminal law is to create doubt in the mind of court and take the benefit.
