Question: Since 2000, I have left my self acquired property as well as
the ancestral property which I got it in the family division, in the
holdings of my brother on oral agreement that he will look after. It
is now about 13 years. Since he is a lecturer, my father was actually
doing all the farming works related to my property. My father lives
with my brother. Since father has become old, for the past four years
my brother on holidays with some help from local laborers, doing the
field tasks. Now, my brother does not talk to me in an affectionate or
friendly manner. So, I am bit worried about his behavior and any
possibility for the future claim for the adverse possession.
To solve this problem, I thought the following options:
1. Ask my brother for a registered Family Settlement Deed that he was
looking after my property since 2000 on my oral consent. My worry
is if he dos not agree for that then what.
or
2. Make the registered Family Settlement Deed from father that he was
looking after my property since 2000. He is in good terms with me
and he will agree for it, as he was actually looking after my property.
or
3. Make a gift deed of all my properties to my wife or son.
or
4. Take a bank loan on my properties.
Since I am unable to choose the best one from these, I seek your
expert advise. Thanking you.
