Stamp duty under the partnership act

(Querist) 18 August 2011 This query is : Resolved 
Sir,

Fresh partnership is executed with two partners, their inital capital amount of rs.5000/ each

2) Partnership Deed already executed with 3 partners having their capital rs.100000/- and therein one dissolve and other coming partner invested their capital rs.200000/- now, please let me help in whether we have to pay the stamp duty on total capital or on comming partner

No. You are not liable for stamp duty within the given facts.

In Rajasthan it is Rs.5oo.

when capital is shown in the deed it will attract duty.The way to avoid duty is to state capital inducted and credited in books
and to draft the deed only on p/l sharing ratio between partners.
