Querist : Anonymous (Querist) 23 July 2011 This query is : Resolved
i am from maharashtra.both my parents have died.i am now living with my elder sister who is not married.we have no problem between us.

my parents have properties in maharashtra & also in agra.DO WE REQUIRE SUCCESSION CERTIFICATE FOR TRANFER OF PROPERTIES TO OUR NAME?
adv. rajeev ( rajoo ) (Expert) 23 July 2011
Not succession certificate, you need survivors certificate issued by the Tahasildar of the Taluk.
R.Ramachandran (Expert) 23 July 2011
In fact you need legal heir certificate. You have to make an application to the Tehasildar concerned (of the place where your parents used to live) accompanied by Death Certificate of your father and mother. After enquiry, the Tehasildar will give a Legal Heir Certificate mentioning you both as son and daughter of the deceased and that you are the legal heirs of the deceased.
On the basis of such legal heir certificate you have to approach the authorities concerned to mutate your names against the property.
Once this is done, both of you will be recognised as the owners of the properties in question.
