Consumer Protection Act, 1986 - Allotment of flats by Housing Agencies - Delay in delivery of possession - Interest on deposit - TDS from interest - Deficiency in service and misfeasance in public office - The Government Housing Agencies must act in fair and reasonable manner - If the Government Housing Agencies are unable to deliver possession of allotted premises or the possession is unduly delayed, the allottees are entitled to compensation for mental agony and harassment and loss - Allotment of alternative plots on a higher rate may not be acceptable to allottees - They are entitled to 18% interest on deposit from the date of deposit till the date of possession or payment/refund without any deduction of TDS - TDS deducted ordered to be refunded with 18% interest.
