Tenant absconding

Namaste sir

I rented to one person a small room on first floor of our house

Now tenant not paid rent past 8 months and on absconding by locking the door
His mobile is not reachable

How to open the door and to let out others
Through some sources i came to know he living at his native by doing agriculture

Now what should i do

Please advise as 11 months agreement also expired

You have to follow the process of law to get it evicted

File suit for eviction of premises against tenant and get order/judgment in your favour thereafter to get vacant possession of premises execution petition has to be filed.

If time frame is not fixed in obtaining eviction order then owners will be the loosers and tenants will have all options in misusing our law system

It's like this

A tenant occupies by paying 1 lakhs advance and 10000 monthly rent
Then tenant will not pay rents and thus filing for eviction order and before serving legal notice

If all these process happens after one year and then the tenant absconds by changing mobile SIM

So the advance taken from tenant goes to legal expenditure

Here tenant didn't paid any rent more than a year or two years

The tenant on knowing that eviction order is served by the court and then he vacate the house without owners acknowledgement

Finally owner will be the victim

If eviction order is served within 6 months then owner will get justice from the bad tenants

If the tenant is not appearing before court after receiving the court summons, then the court may set him exparte and once you furnish exparte evidence before court, then the court will pass the judgement immediately and there are possibilities that the sec can be disposed within three to four months too, hence without trying anything do not become frustrated.
