Time limitation to file appeal against cat order

Querist : Anonymous (Querist) 06 July 2022 This query is : Resolved
I had filed a case in Central administrative Tribunal as party in person. CAT ordered in my favor. However, respondents have not implemented the order. I wish to know that what is the time limit to file an appeal in High court against the CAT order. So i can wait until such period is passed before initiating contempt petition.

1. What is the time limit to file an appeal against the order of Central administrative Tribunal?

2. Kindly quote the relevant provision.

Any order passed by CAT is "non-appealable".
The order passed by CAT can be assailed in an appropriate writ under Article 226 & 227 of the Constitution of India before High Court of jurisdiction, however, there is "no" limitation prescribed for invoking writ jurisdiction, but it should be within reasonable time.

You may consult your lawyer who can advise you correctly even it is under Appeal. Appeal is time bound and hence you act as advised by your lawyer.

Yes, the decision of the Administrative Tribunal is final and there is no provision for filing a statutory appeal. However, the Order could be assailed under Art. 227 on the limited questions of illegality/irregularity in a Writ of Certiorari. There is no time limit.

In the instant case, the CAT having passed the Order the authorities bound to implement the same within three months or as directed. In case of non-implementation, you may move an Application for Contempt.
