To prevent unnecessary litigations

Dear Sirs,

Iam a senior citizen. My neighbour is an advocate. He is forcing me to sell my property in a village (near ballabgarh, in faridabad) to him, which I don’t want. He is unnecessarily forcing my in unnecessary litigations by filing wrong civil cases on me. As he sits in the court, it doesn’t makes a difference for him neither money wise nor time wise. But Iam a working person. I have to take leave on the day of proceeding and have to pay fees to advocate also. Earlier he had filed a case by submitting a false case along with a false affidavit and now he has filed a new case on me. Is there any provision by which I can brought him to books and prevent him from doing this.

Please help and advise.

if he had filed false case and false affidavit against you make an application under section 340 CR Pc for perjury .

Moreover you can lodge complaint with the Bar Council citing the false cases filed by him to coerce you to sell the property in his favour.

I feel sorry for an advocate like him.
But perjury and complaint in Bar council is the only way out.

Now a days instances of frivolous and vexatious litigation are on rise and we do need to evolve some system to short out and throw them at earliest stage
for which mechanic of law is although there but too poor and ineffective.
