Transfer deed in favour of charitable trust

(Querist) 15 June 2014 This query is : Resolved 
A Person wishes that 50 % of his house should be used for the purposes of a charitable trust created by him while 50 per cent share of same house should devolve to his son. Same should be done with sale proceeds from the house after his death. Should he make will to effect or transfer deed would suffice to teh effect. Would two transfer deeds be made or provisions can be made in one transfer deed itself. can transfer deed be done in favour of charitable trust.

For transfer to trust, the trust should exist. There is nothing wrong in bequeathing the property in equal proportion to a trust as well as to his son by executing a Will, the testator should have valid title to the property being bequeathed.
