Transfer of mhada property

Querist : Anonymous (Querist) 25 August 2011 This query is : Resolved
Hello,

i have purchased a property from the person who was alloted this property under Mhada. He made a power of attorney and a sale deed in my favour on Rs. 100 stamp paper in the year 2007, however the same is not been registered.

i understand from the rules of Mhada that the beneficiary can not transfer the property till 5 years from the date of possession.in this case i would like to know my legal standing in the property. i have also been given the possession of the property, can the Mhada or the beneficiary claim any rights on the property ? do i need any more documentation to safeguard myself ?

you have no legal standing . you are aware that MHADA flats canot be sold for 5 years yet you went ahead and bought the property .
if tomorrow MHADA discovers about the fraud it will cancel the allotment made to seller .

always consult a lawyer before you purchase any property
