Id after the owner of a flat is deceased, there are three legal heirs, how do we transfer the ownership of the flat in the name of one? One of the heirs would like to gift his right on the property and the other is ready to relinquish the right in leiu of money. How many documents will need to be made and whats the registration/stamp duty charges in Mumbai for the same? What is the final documents which completes the ownership tranfer in the name of one person in the above scenario? This is to be used as address proof to change the name on the utility bills etc. Is there any role for the co-operative society in the above procedure?

I am sorry Mr. Barman, waht I am confused about is....
1) Is mutation of the property the next logical step after registering Relinqushment deed?
2) What is the approximate cost of Mutation in Mumbai? Is it a percentage of the property value?
3) Is there any role for the society in the process of ownership tranfer?

without society permission flat cannot be transferred in name of legal heirs

The shares in the society has been nominated and the mutation needs to carried out in the name of the same person, who is also one of the legal heirs. Since the nomination exists, the shares have been transfered to the nominee. Is there any other role for the society? How to proceed with the mutation and what will the cost involved?

nominee is only a trustee for other legal heirs . there are other legal heirs to property . society has no further role to play after transferring flat in name of nominee

The relinquishment and gift deed favoring nominee need to be prepared and registered. With the copies of these mutation can be got done.
