transfer of property rights

Dear sir

due to my father was passed away. We want to transfer his property to my mother name wat is the procedures.

your query is not clear, so give all details of property, its ancestral property or self acquired property, how many child and father have any documents regarding that assets.

The property cannot be transferred to your maother's name alone. Because after the death of the father all the legal heirs of the deceased are entittle to equal share in the properties. If you want to transfer the property in your mother's name all the legal heirs will have to relinquish their rights to your mother by executing the rights relinquish deed.

You all other co-sharers can legally transfer your share in the name of your mother. There is no problem in it and even there is no need for you to tell the details of entire property here as asked by an expert.

You all get registered a Relinquishment Deed before Registrar which shall give exclusive rights in favour of your mother.

when a person dies intestate there is no difference as to the property in question whether it is self-acquired or ancestral. In both cases passing of the title to legal heirs is one and the same as explained by experts Mr.Rajoo and Mr.Makkad
