Transfer of share certificate

(Querist) 13 May 2013 This query is : Resolved
My husband and me jointly owned a flat in Navi mumabi. We have two sons whom we both had put as nominee. Now my husband expired last year and I want to transfer the share certificates in my name do I need an NOC from both my sons. My husband has not left any will. What is the process if I want to sell the flat?

make an application to society for transfer in your name . you will need NOC from your 2 sons to transfer it in your name . ask your sons to sign ded of relinquishment . have it stamped and regd . after you become absolute owner of flat you can then sell the flat

Thanks so much for the reply.
I have one more question regarding the NOC. One of my sons is in US. How do I get his NOC stamped and registered? Does he need to tarvel to India or can I do the documentation here in India and send it to him for signing.
V R SHROFF (Expert) 13 May 2013
He can send a POA to sign NOC on his behalf.
ajay sethi (Expert) 13 May 2013
send papers to him for signature . have it attested before indian consulate .

you have mentioned that you want to sell flat too . for that advisable that deed of relinquishment be executed by your son
