UDS Issue

Hi Sir

We intend to buy an apartment from the land owners share..

This apartment was planned for 16 flats... Eventually reduced to 15 flats as the Plan permission was given only for 15.

However the uds was divided into 16 and was appropriately sold to the individual flat owners by the POA given to the developer.

The land owner has 3 flats and has a share of 4 uds... which was built 20 years ago..

I am planning to buy two of them...What happens to the excess uds? Will there be objection from the remaining 13 flat owners as the flats I am planning to buy alone come with higher UDS..

Before finalising any transaction it would be better to seek professional services of a local prudent lawyer, which is for the sake of protecting your interest.

Your whole description lacks the most essential information, whether you want to buy the unauthorisedly constructed flat or only the authorisedly constructed flats?

So far as your question, "Will there be objection from the remaining 13 flat owners as the flats I am planning to buy alone come with higher UDS," is concerned, that is quite irrelevant. How you can expect any reply from the experts on behalf of the flat owners. You may better contact personally the flat owners to enquire about your question.

You can ask for the opinion of experts, only after discussing about the response from the flat owners.

However, if you have the desire to buy one of the unauthorisedly built flat and ready to take risk about that, no advice can suit you, as nothing can be anticipated about the future of such a flat.

Hi sir

For sure I am in touch with a senior lawyer...this is posted for expert advise..

This is a plan approved by local planning authority property.. presently all 15 are approved... planning to buy two of them..the point is I need clarity...as I am buying excess of UDS ie which by the way of four uds for three apartments owned by the primary land lord...

All apartments are similar sized of 980sq ft and each of them has 600 sq ft uds...but the land lord have 2400 sq ft of uds for three flats of 980 sq ft now...what to do?
