Union of India files a petition against Government of Delhi under article 32. Can Union of India claim its breach of fundamental rights under article 32. Can Union of India have any fundamental rights and claim it under 32? Why did it not approach the Supreme Court under Article 131 of the Constitution ( Original jurisdiction)?

union of india (state) is fictitious person, it can sue and can be sued.even, state can claim protection of its fundamental rights.

under Art 32 of the constitution of india, supreme court is the protector and guarantor of fundamental rights. so, union of india is rightly approaching supreme court in its writ jurisdiction.
