Sir/Madam
An attempt of withdrawal made at United bank of India ATM which was unsuccessful & for the same I have receipt and I am the customer of Axis Bank I made several complain to axis bank but after 40 days also i did not get suitable reply.
Ques: Can I sue a case to consumer forum online and against which bank? Please guide me adequately.

Your complaint lies against Axis Bank but you may make UBI a party to the consumer case.

When you say that "An attempt of withdrawal made at United bank of India ATM which was unsuccessful & for the same I have receipt and I am the customer of Axis Bank" - do you mean to say that when you yourself genuinely wanted to withdraw money from ATM you could not do so. (and it is not that somebody else attempted to withdraw wrongly from your A/c through the ATM)
Please confirm.
In the receipt, what message has been written?
Thereafter did you withdraw money through ATM or not?

Dear Anirudh Sir
I tried to withdraw cash from UBI ATM the message displayed on screen Sorry unable to dispense and I took the print out of same(Receipt) and again I went to Axis ATM from there I made an withdrawal and took mini statement from there I came to know that cash has been debited from my A/C while UBI ATM transaction also.

You say that "I took the print out of same(Receipt)"
From that print out what one will be able to know - whether it will show how much money withdrawn by you (in this case zero, as you were unsuccessful) - the balance available in your account etc. (there should be no change as you did not withdraw).
If the receipt in your hand does not show the above details, then what is the use any such so called receipt? How will you prove that you did not withdraw the money?

More over in application I sought for CCFT footage whether I took cash or not, mere depending on the Bank report no one can prove. Every thing lies with bank i.e, CCTV, Bank report & even print out was also given by their ATM. Then why they are worried and escaping to show. Today we live in IT world. so we must seek its help. Hope u understand my issue now.

Purely a Time Pass Query Un Fit to be a Legal Issue,Technical Faults can not be Sued,If not there you should have tried else where.

I hope the same transaction No. is shown in your bank statement also where the amount is shown to have been withdrawn (while according to you the receipt says unable to dispense).
If that is the kind of receipt that you have in your hand, then issue them a legal notice and proceed further.

Dear Author,The Problems to be seen in a Practical manner with Ethics.There should be so many reasons for the Denials Like Technical faults Or No Cash Etc for which it can not be sued.Even in Banks which are Fully Computerised in Electricity Failures there would be No Activity.These are all Routine and No Legality is Involved.More over you understand and Check and Confirm that when Cash was Not Released By the Particular ATM it would Show Contra Entry and There would be No Change in the Balances.If at all Really and Genuinely Had Such Problem you Should have Gone to that Nearest Branch of that ATM Immediately Or if after Office Hours The Next Day Immediately and Should have Sorted it Out And Your Bank Will have No Role in This.

RBI under the Payment and Settlement Systems Act 2007 had made it mandatory for all banks to restore the failed transaction amount of the customer within 12 days, or pay penalty at the rate of Rs100 per day to him.

If the amount was debited from your account but the cash was not dispensed, you have lodged the complaint with the Bank, file case with the consumer forum making party to both Banks.
