This query is : Resolved
Sir, I have joined this company in nov 2011 and working as a Graduate Engineer Trainee since then. They made me sign a bond for 3 years having a bond valve of rs 2 lac. Now I am getting a chance to do MBA (I am Btech in mechanical Engineering) and really want to do it. Kindly guide me through a way that can help me escape the bond.
My probation period is one year. I have not been given any training till date and there is no such training schedule for fresher (like me) in this company and I am the only fresher in the company. A 5 day training program is given to every employee in my field.
They neither have any of my original documents nor have taken any advance money from me.
I am even not interested in taking the NOC from them.
Also, they have not even given me a copy of the bond.
Kindly help me through this.
Your suport shall be highly appreciated.

Thank you Ajay Sir for your kind consideration.
Sir, the company denied to provide me with the a copy of the service bond but my letter of intent says that they are offering me a job as GET in design and engineering and my training period is of 12 months and after successful completion of training period my services shall be confirmed in writing and I shall not be deemed to be confirmed until I am given in writing. And on day of joining I shall sign a bond /agreement for minimum period of 3 years.
But I have not been given any official training. They are just making me work at their corporate office from the day of joining.

A service bond is an agreement between you and the company and you have to right to ask for a copy of the same for your from time to time and record. Denial of your company to provide a copy of that bond is not understood.
About training, may that be on job or through some organised training, your service period during the probation period, itself, is a sort of in-service training for the specific period, as you are treated to be learning the work and culture of the company through on the job learning process and day-to-day experience.

Thank you for your reply Dhingra Sir.
I requested them for a copy of bond the day i joined this company and there was a straight forward denial.(I joined this company in Nov 2011)
I have been following-up for the copy of service bond for past 2 weeks and I don't see a positive response.
Sir, i would like to know is there any way, if i leave the company in order to go for my higher studies i might not have to give them the bond value?

if you have signed the bond you cannot leave company before expiry of bnd period . company will seek to enforce bond

Also sir, if you can clarify me on the condition of two sided bond as I've heard that a service bond is valid only and only if it is a 2 sided bond i.e. if i leave the company within the bond period i will have to pay them and if the company relieves me inside that period they will have to pay me the same amount(bond valve.)

With your supplementary query you seem to have sidetracked from your problem that you posted originally. Better get a copy of your bond from your employer and see what actually are the terms included therein and agreed upon by you. You cannot go beyond the scope of those terms.

Dont worry. Breach of a bond does not create any offence. You may be liable for only up to 2 lakh. I am sure that no bond is prefect and there are so many ifs and buts.
What the campany can do? it can file at the most a civil suit against you for recovery of amount.
Do not worry up to next 5 or 10 years in case the company files a suit.
I assure to you that the Company will not file any such suit because chance of success is very little.
So practically do not bother the bond instead bother your new books.

it is stated that i'll be on training for 12 months and my probation period is 6 months. i am into my 8th month into the job and no confirmation letter has been handed to me nor anyone has got salary hike.
nor my probation period has been extended i.e. neither i've been told about the extension nor have got any written confirmation of extension of probation period.
is bond valid in probation period.????
