Vacations for courts

(Querist) 03 August 2010 This query is : Resolved
Do all the courts in India have summer vacation(or even winter vacation)?
If yes, how do the Hon'ble Courts find it reasonable to take vacation despite thousands of outstanding cases pending in courts for years, waiting to be disposed of?
Judiciary is the most important wing of our democracy. We never heard of any summer vacation for police or any law enforcement agency. Then how can the courts have such vacation?
Raj Kumar Makkad (Expert) 03 August 2010
The provision for leave has been made constitutional. If anyone feels to get this system of vacation changed, he must approach to the law making agency means parliamentarians to get the work done.

Personally I do agree with you that if we want to minimize the long pendancy of court cases, the long vacations should be withdrawn at once and infrastructure should be provided in courts including the strength of judges, working hours of courts, evening courts, village courts, involvement of Panchayats in the justice delievery system, alternate judicial system, departmental courts etc.

vacation is meant for providing some kind of time for the judges to rejuvenate themselves and come back fit for their duty. the duties of judges and their mental tension while decideing cases and delivering judgements is very high. they naturally require some rest to be fit and agile. otherwise it will lead to disastrous results. after all they are also humanbeings only.

I fully agree with Mr. Makkad.

I thank you all for the replies.
My supplementary question is:
Whether anyone ever lodged a PIL or something against vacation for courts?
If no, I wonder what made PIL Activists wait for so long!?

If these arguments are acceptable then vacations are must for every public related services in this country. We bank officers slog for more than 15 hours a day and get even our legitimate leave entitlements elapsed for the sake of society. I am not exaggerating. This is the harsh reality. MPs can walk out any number of times without even attending parliaments to successfully claim hike in salary and perks and citizens can witness umpteen number of adjournments without fruitful results. Age old British concept of summer vacation must go

Law enforcement/Investigation agencies do not have summer holidays. One only can imagine the magnitude of work pressure and other social and political influences on them. They work 24/7. They form an essential and crucial part of criminal justice. Nobody ever asks if the police is facing any mental tension or stress. It is taken for granted that police are bound to face all this and still work efficiently and effectively.
It is utterly shocking to know that the abodes of justice enjoy such holidays. They must employ measures as suggested by Mr.Makkad.
I think no other profession in India has such holidays. Once we come out of college, we consider summer holidays as a thing of the past. It's very surprising and shocking to know this. Thanks all.
