Validity of ikrarnama

Querist : Anonymous (Querist) 19 April 2022 This query is : Resolved
I have an ikrarnama on a Rs.500 stamp paper for sale of a certain property but the same is not notarized by any notary. The said ikranama contains the amount at which such property is sold and also the clause that it can be sold further without seller being able to claim it. What is the legal enforceability of such Ikranama and how can I check if it is real or fake?

The agreement would have specified period for completing the transaction. You may file a suit for enforcement of the agreement within the specified time limit.
Advocate Bhartesh goyal (Expert) 20 April 2022
Said ikrarnama ( agreement ) is neither duly stamped nor registered hence not enforeable until and unless duly stamped and registered as per registration Act.

How can say whether the ikarnama i.e. Agreement is real or fake without verifying it? As per your query, it is a sale agreement but not notarized or registered. You may file a case for enforcement then the court may impound the same if the court admits your case.
Dr J C Vashista (Expert) 21 April 2022
The iqrarnama is just an agreement to sell a particular property as per agreed terms and conditions, which may not be notarised / registered.
