validity of oral will

how effective is oral will for transfer of property in the name of legal heir? please advice.

Although no legal provision requires a will to be necessarily in writing yet practically it is very difficult to prove an oral will. There are even judgments that law does not recognise oral will.

The Indian Succession Act makes it necessary under the Act to have a written Will.
Oral Will has no legal sanctity.
It must be signed by at least two witnesses.

Military personnel on active duty can make a WILL orally in specified circumstances in terms of Indian Succession Act.
Wills deal with transmiision of property and not transfer of property.
