Water tank mounted by teant

(Querist) 05 January 2021 This query is : Resolved
We have tenants since 1940

They built a cement water tank of 1000 litres in our garden 20 years back
Also mounted 1000 litre tank on terrace

Can we remove their water connection from tank built in garden as they didn't take permission
Also tank on terrace as it's causing load to old building

They're only 4 people staying in our 1500 sq feet area at andheri east for rent of 100

Though it would be Expensive it would be better and beneficial for the Land Lord to go thro Eviction Proceedings

No, you can not legally remove / break water tank which had been constructed 20 years back without your consent .What were you doing these 20 years? Why did you not raise objection that time? Now it would be deemed as your implied consent and now you are estopped to take any action in this regard.

You can take permission for demolition from safety angle.

You can not remove it after 20 years of construction. Can move to court for permission.

Instead of removing water tank at your own it would be better to settle the issue amicably otherwise consult and engage a local prudent lawyer for appreciation of facts/ documents, professional advise and necessary proceeding.
