Whether i am a consumer under consumer court if not where i file the suit?

I have contracted M/s NICT for getting CSP Kiosk Banking agency of State Bank Of India and paid them Rs.20000/- as processing fee.
But even after 3 months I did not get the agency to run the business. Whereas they assured me that it will take 1 month max.
I have wrote them various emails but they don't even reply or give any feed back on the progress in the matter.
In my opinion it is breach of contract on part of delayed commitment.
Can I file the case against them for refund of proc.fee and damages and interest.
Please guide.

You are not a consumer. You can file a civil suit.

I am not employed but I am having a properietership firm dealing with online services for the last 3 months.

Write to state Bank, Regional Manager, General Manager, Chief General Manager, Chairman regarding this. Also send e-mails.
