sir, after i filed divorce, my wife filed false 498a an gone to her parents home? (i guess i don know exactly) without informing me. its nearly one month over. no communication nothing. is it desertion? how can i use this as advantage for me? what are the possibilities? regarding diovorce as well as maintainance.can i avoid maintainance if she files for maintainance . she is doctor may be working in mumbai.how can i utilies this opportunity. please advice me sir.

on what grounds you have filed divorce? your wife left you without informing you one month back, you cannot take the advantage of one month as desertion ground.

Your wife left your house without informing you is just one instance of cruelty and not a ground of desertion, because one month period is too short to constitute desertion.

hi Archana abd Rjiv ,
i have filed case on cruelity grounds and she left without informing me probably she has gone to her perents house but no contact from her side after they filed false 498a.they are not attending court dates also. already 3 dates over they not even filed objection after my notice. how cruel such women will be. forgetting all good things i have done for ,forgetting good meories i have given to her but she is always been cruel and harassed me and my family members with false case of 498a. bad thing she did is put my doctor collegues name in false case who is best famous pediatric doctor married gentleman once advised her to adjust with marriage institute. can he file case against her and her father who instigated her. how can i use her left home attitude.pls advice.
