Working hours for female employee

Dear Experts,

This is in reference to know about the working culture for FEMALE EMPLOYEES in INDIA. I am working in MULTINATIONAL BANK "ICICI BANK LTD." That branch is mega branch and timing is 8:00AM to 8:00PM. According to this timing branch should run in two shifts but I haven't seen that in my branch. When we sign-in in the system it show working hours should be 8hours but we works more than 10hours in a day, in which only 15-20mins we will get for lunch, no other things and even after doing OT we haven't paid any extra wages for that. I am working since last year in this organization, having some severe health issue which is not severe according to HR. They accept that many female employees are suffering from that even after knowing that there is no improvement in this. The best thing is that HR haven't met with me even haven't saw my reports before making that statement. I am working in such an organization where working environment is not professional and co-orperative. I am posted far away from my family. Due to my medical issue I requested for transfer but didn't get yet.

Kindly suggest me what should I do next

TRY FOR ALTERNATE EMPLOYMENT IF YOU'VE QUALIFICATIONS AND EXPERIENCE FOR THE SAME.TILL THEN BIDE YOUR TIME HERE. iF YOU CAN AFFORD RESIGN AND-BE ON THE LOOK OUT FOR NEW EMPLOYMENT.

The bosses may claim that employees stayed after 8 hours on their own..

You have posted that while marking attendance the computerized system confirm that your work hours/day are=8 and you can take screenshot without any problems.
And that the establishment must have employed additional staff to handle workload….but has not added adequate manpower.
The HR person contacted by you has commented that extended work hours have not lead to any medical problems that are pointed out by you by attaching medical documents.
This speaks in itself that line management and HR are not inclined to agree with you and other employees.

Perspectives;
If IT is all women branch all staff (preferably jointly or thru Employee’s unions if IT exists) may ask the Line Management and Hr to add manpower to handle workload.
Or staff (preferably jointly) may ask for OT.
The establishment may agree/may not agree.
Keep on pursuing. Apply your skills; persuasion, persistence, reasoning, negotiations.
One day IT may agree to add manpower or even to pay OT.
Or separate and join any other establishment.
If eligible (and evidence exists) claim OT and establishment may pay or you may have to approach appropriate forum to agitate. In any forum management may not easily agree that IT violated any right of employee(s) and evidence may be required.
Discuss in person with your own very able senior LOCAL counsel of unshakable repute and integrity specializing in Labor/service matters and having successful track record ….. and worth his/her salt …and discuss in person and even with seasoned employee’s/trade union leaders/IBA and proceed in best of your interest..
Check at LOCAL Labor Court/CGIT, Controlling Authority of Gratuity, School-Educational Tribunal, CAT, Civil Courts, HC,SC……..for such counsels..
Weigh all pros and cons and take your decision as deemed fit.
