Wrong declaration of claiment

dear sir ,
my client is fighting a case of arbitration with GAIL GAS in Delhi. my client is from meerut U.P.
when he has gone for the first hearing he was declared as a claimant to the case which the opposite party GAIL gas has lodged against him . the Gail gas has them selves become a respondent to the suit.
now please help me in the following ways
a) can i get the suit dismissed on this grounds that the declaration of the parties is wrong in them .
b) if yes then please give me some case citations for the same .

Are you a party to the arbitration proceedings?
if so whether you initiated the proceedings or the GAIL?
What is your claim in this regard for which the arbitration proceedings have been instituted?
Whether the GAIL has wrongly mentioned you as a claimant ?
What is the subsequent suit meant for?
Arbitration proceedings is not a suit.
If the proceedings are going on, you may challenge as a respondent on the basis of merits and documentary evidences in your side.
