138 civil suit

I want to file civil suit against one accused who is declared abscond in criminal 138 no court . But that accused is not reachable and problem is that she don't have property on her name , but her children's from first husband have property on their name and she is legal mom and can't sell that property until her children get mature . She is married to some one else and her first husband is dead and her children have property on their name not on mother's name but she is legal Gaurdion . So can I have any chance to get that property attached in civil case on mother's first husband's (who is dead) children's property ????
