Could anyone please let me know about Admission Hearing in Criminal Motion u/s 397/399.
Is it possible such hearing may occur on the date of filing itself without the presence of opposite party's advocate? How come an order can be passed without the presence of opposite party's advocate? Please clarify.

Yes , Motion hearing is first stage to check whether the matter having any legal ground to accept the revision or not , after revision accept notice issue to the opposite party . In motion hearing court may be pass order for proceeding stay.
