Affidavit

My client wants to transfer his flat to his sons name as a gift. Hence he needs to make an affidavit to tht effect. Can somebdy upload tht format of the Affidavit that needs to be submitted to the Society.

Advice your client that by affidavit the title of his flat cannot be transferred to his son. The proper way is draft a gift deed and get it registered.

As per section 17 of the registration act any immovable property worth above Rs.100 should always be transferred by registered title deed in the Office of District Sub Registrar, Patna.

It cannot be transferred through affidavit.

A Gift Settlement Deed has to be registered by your client in favour of his/her son.

if it is Co- operative Society Flat with dual ownership with Society and Members the Flat can be transferred by Share  transfer , ---

otherwise the Flat should be Transferred under Regd Gift Deed only
