There are two types of charges namely criminal and civil. The civil charges do not affect the government's job. However in the case of State of West Bengal and Ors vs Nazrul Islam the Supreme Court declared that the person facing criminal charges or is convicted for such an offense is not suitable for a government job. According to the law if a government employee spends more than 48 hours in police custody he is suspended. Mere FIR will not affect the position, to have any effect there should be court proceedings or the person must be convicted for the offense.

1. Accused is Innocent, till proved Guilty & Convicted by a Court of Law.
2. TILL the above, accused is entitled to a Govt. Job, with proper disclosure declaration about pending court cases etc....
