Respected Sir/ Madam, My uncle was given his land to a builder for construction of a apartment, completion time period is two years. One year back two years completed, but till now apartment not completed, builder agreed for pay rent/compensation per month 60,000 if not completed the project in two years, but it is not paying from last one year, served legal notice for rent also rejected. My uncle planing file suit for change builder, but there is arbitration clause in development agreement, there is builder change clause too in agreement, clause say if mentioned time not complete the project land owner can change builder.My uncle doubt is which clause supersede which clause? conditional period over one year back, still arbitration clause in force? or can directly file suit for change builder/ cancellation agreement? property situated in Secunderbad.
