Builder extended the rera date by 1 year

Hello, I have purchased a flat in October 2021 in Thane, Maharashtra. At that time, I signed the agreement where the possession date was mentioned as June 2023. But now on RERA website the dates are extended by 1 year i.e June 2024. I asked the builder about this extension so he replied that it is given by RERA and they have not applied for extension.

Also I was frustrated so took this to Twitter mentioning the builder and few news channels so now builder says to me that he will literally give the possession to me very very late i.e in the last and threatened me that he will file a defamation case against me.

I am only worried about my property because during the time of purchase, the sales people made false promises that the flat will be delivered by June 2022 thought the agreement date is June 2023 but now the date is extended to June 2024 and its been a tough time for me to stay on rent every single month.

 

Can you please suggest/advice me if there is any way we can claim compensation on daily basis since July 2023 till date?

You can back out from the agreement as builder has delayed the possession by one year. You should file a complaint before RERA for refund of advance paid and compensation along with interest for delayed possession. You can get compensation for the delayed possession.

A builder is permitted maximum two extensions of 120 days without paying delayed compensation , after giving proper written notice to the owner of the flats.

 Otherwise a flat owner is entitled for delayed compensation 

They cannot refuse to pay compensation if there's an inordinate delay.

You can approach RERA or even consumer forum seeking the said relief.

The builder cannot take you for granted on this.

Hi Sir,

Thank you for the response. 

The builder says that this extension is as per RERA which was given to every project due to COVID.

Can I still file a complaint and demand for compensation for the delayed time?
