Can i eligible for gratuity after 4 years and 240 days

Sir,

I am currently working in pharmceuticals company (on notice period) and completed here 4 Years and 250 day. When i asked for gratuity company denied orally for gratuity amount by saying i am not eligible before complete 5 years.

My DOJ is 10.03.2011

I also read madras high court judgment about 4 years and 240 contineous working.

Now, I want to know really i am eligible or not for gratuity ?

If eligible what can i do further, please suggest.

You can submit FormI under proper acknowledgment 30 days before LWD.

The Act itself provides for that if establishment works for 6days/week or less than 6days/week then employee should have worked for 240190 days/year.

No judgment is required.
