Charge sheet and fir

Chargesheet is filed after FIR and after police investigation. This is post investigation findings along with the witness statements and affidavits. Thechargesheet names the persons against which the charge is submitted this may include additional persons that were charged in FIR or there may be some less.

If one's name is mentioned in the charghe-sheet as an accused, he / she has to face the trial in the said criminal case, even though his / her name had already not been mentioned as accused in the First Information Report, i.e. F.I.R.

However, if one's name is not arraigned as an accused in the charge-sheet, he /she does not have to face the trial in the said case because it is presumed that he / she has not done anything unlawfully, even though his / her name had already been mentioned as accused in the First Information Report.
