Civil suit

if a defendant failed to make a counter claim in his written statement, whether he can file a separate suit for his claim? the said claim is under limitation period for filing the suit. Request for answer with supportive judgment.

Yes you can claim set off or file a counter claim by a seperate suit but it is always expected that you should have raised all your objections at earliest. However do not worry. Carryon.
