Common wall issue.

2 plots side by side. One belongs to Gurprit. Other to Hanspal.

In Gurprit plot. First floor and terrace belongs to Hanspal. Terrace has a no construction agreement between the two.

Hanspal is forcing construction on his plot and joining the first floor and terrace illegally without Gurprit permission, with no common wall or plot clubbing issue.

He is saying that on paper he will show that the house is separate and raised by 1.5 to 2 feet from the first floor house, but from the inside, will be usable as if the two have been clubbed.

Kindly help. What legal help can we sort?

The only way to get it repaired is filing a petition and getting orders from the court to do.
You can also primarily send a Notice to your neighbours and if they do not give their consent then you can move an application in the district court.

A tort case needed to be filed in civil court as per your area area jurisdiction.
Definitely a common wall maintenance is duty of both the neighbors and owner.
I advise you to consult us or any other civil laywer to pursue matter further.

Respected Anaita Vas, 

Both are real brothers. 

We want him to club the plot and make it common property between the two. But he is insisting upon using it only for himself and not letting us get the benefit of either the clubbing or the common wall. 

He is using our staircase, that is in our plot but on paper is showing that the house is separate, but in practicality, is using our plot to go into both of his houses. He is not letting us use the terrace, or the parking. But he is using our plot for stairs.

We are wanting to resolve and make property either separate or clubbed. But Hanspal wants to keep it separate and use it as clubbed, from thr inside, illegally. Kindly help.
