Deposit for internal repair in coop housing society flat

I stay at Mumbai Maharashtra and our housing society has made a rule that for internal repair of flat in coop housing society that "for carrying internal repair works, member shall be required to deposit Interest free refundable deposit of Rs 25,000/- for major repair & Rs 10,000/- for moderate work with the society as security against any damages and after repair work is completed the deposit will be refunded within 15 days"

 

Is it in line with Maharashtra cooperative societys act (MCA) to take such deposit amount ?

1. DEPOSIT for any kind of "Internal Repairs", is NOT within the parameters of the MCS Act, Rules & Bye-Laws.

2.  Society can collected the Deposit, based on the perception of risk /damages to the Society premises, incurred by the Flat Owner for conducting any Internal /External repairs etc.....  HOWEVER, the Society has to pass a General Body resolution via a proper Notice-Agenda-Uniamous Resolution, to collect the Deposit for the purposes.

Is this security deposit which is taken as 'refundable' subject to arbitrary decision of the MC that it will not be refunded? In simple terms, can the MC refuse to refund this deposit? If they refuse what remedies dies a member have against the MC? Please clarify. TIA
