Hello sir,

I am rajnish Kumar, I worked with HBL global Pvt LTD for 4 years and 226 days. just want to know is m eligible for gratuity.

As per sec 4 of Payment of Gratuity Act 1972, an employee who has rendered continuous service for not less than five years is eligible for gratuity.

Post your DOJ and LWD...

From your DOJ to LWD if you have worked for 4Y240D you are eligible..

This includes probation period, notice period, off days, holidays, approved leave...

If employer has agreed to pay for lesser period by any agreement/document then you may stake claim based on It..

and  employer can pay by IT's own sweet will..

You ought to have completed 240 days of work (wherever the industry is working for 6 days a week) to count as a full one year of work.

In your case you have not completed 240 days and as such you are not eligible for payment of gratuity.
