Foreclosure charges by HDFC Bank

We had a property loan sanctioned of Rs. 1.80 Crores out of which we had taken disbursal of Rs. 1.72 crores from the Centurion Bank of punjab (Now HDFC Bank Ltd.). At the time of taking the loan it was told that if we pay the administration charges we have not to pay the foreclosure /preclosure charges. But When we approached the bank after 2 years of the loan for foreclosure they charged prepayment charges @2.50% on the total financed amount. We go throgh the agreemnt signed by us we found that we have not signed near the foreclosure charges clause of the agreement. Even the bank have not mentioned the foreclosure charges in the saction latter.

Pls advise we should take over the case to Court.

you are requested to appraoch the Banking omubdsman in this regard, you can also approach the consummer disputes redressal forum and the civil court, But Omubdsman remedy is the quickest one and cheapest, look for ombudsman e-filing in the net

 As suggested by Adv.Jayavel, writing to the ombudsman is the quickest remedy. You may also escalate the matter by email to senior officials/Grievance Committee HDFC. Usually they are sensitive to genuine grievances and amicable resolve the same

Please check up with the bank and demand for a copy of documents wherein it is stated or construed that they are entitled to charge 2.50% as foreclosure charges
