Is Right to Speedy Trial is also available in divorce case?

 

Dear Experts,

Main main demand is adoption of her child from earlier marriage and main concern in filing RCR is they may file false cases of DV ,dowry etc. although one safety net is she has given in writing that no dowry has been given , they are separate for 9 months, she is already divorcee and has taken huge money in first divorce.Husband use to bear all the expenses and was paying fee for her child through cheque.She waS CRUEL TO HUSBAND AND MANY TIMES BEAT HIM, HIS CHILD WHICH HE MENTIONED IN HIS MAILS TO HER AND EVEN ONCE BROKEN HER HAND.SHE DO NOT RESPECT HIS FAMILY MEMBERS, MANY TIMES SHE REFUSED PREPARING FOOD,SENDING CHILDERN TO SCHOOL,FOR SEX AND EVEN FOR SLEEPING WITH THE HUSBAND, STOPPED TALKING OR RESPONDING FOR MANY DAYS AND ALSO SAID THAT SHE LOVES TOO MUCH HER EX-HUSBAND. ALL ABOVE HAS BEEN CONTINUOUSLY MENIONED IN THE MAILS TO HER BY THE HUSBAND.

PLEASE SUGGEST WHAT TO DO ?

U shud 1st decide, whether t 2 take her back??? if she is so cruel as u told. If not dont think about RCR. Collect ur proofs of cruelty & go 4 divorce!

Speedy trial is myth!!

 

There are so many fundamental rights which are crushed below the feel everyday in India.

Adjournments is a epidemic which has no solution!!

 

Let's say there are 4000 cases pending in Family court and 4 courts/judges.

so 800 cases per court.

 

Atleast 40 cases (???) are posted on daily board!!! which makes 20 days for hearing by round-robin method.

 

 

Then other 'practical' parameters such is advocate available on that day?

 

 

If you want a speedy trial then appoint a full time "Family Matters only-Advocate" who comes to same court every working day!!! This would solve your major problem.

 

Opposite party of mine and her advocate! (since adv.  practicing in family, civil, banking, criminal etc courts) they have been playing 'hide and sick' and remain absent without fail every alternate hearing!!!!

 

How to tackle all this life wasting tactic!!

 

 

THE ONLY SOLUTION IS TO RAISE THE VOICE FOR CHANGE OF BIASED LAWS’S TOGETHER BY FOLLOWING :

 

SENDING REPEATED LETTERS TO PRIME MINISTER,LAW MINISTER,SECRETARY LAW, MRS.SONIA GANDHI, MR.RAHUL GANDHI,MR.L.K.ADWANI,

SPEAKERS OF LOK SABHA AND RAJYA SABHA,PRESIDENT,LEADERS OF POLITICAL PARTIES, LG, POLICE COMMISSONER,REGISTRAR OF COURTS,CHIEF JUSTICE OF HIGH COURT’S,CHIEF JUSTICE AND REGISTRAR OF SUPREME COURT,DISTRICT JUDGE AND SOCIAL ACTIVISTS ETC..

 

PLEASE SEND DETAILED REPRESENTATIONS TO THEM WITH IMPORTANT ARTICLES.

there are many many such provisions and every wants to go fast , how it is practical.
