just an information

hi friends, this is ravi here from chennai, i want to discuss and know the fact on an incident, two days back happened in my area, i was standing opp. to the police station in my area for the bus, at the time a girl around 23 yrs old, and she rushed in and around the police station with few of her friends, through her tele talk i came to know that she was informing and asking her friend to take an auto and come immediately with a lawyer.... after the talk i came to know that the problem is salary. nearly 20 persons gathering and they came with a complaint that their management not making the payment of their salary........... this is the issue..... right........ ok now my question is immediately what they can do? mean what they have to do..... and seeking a lawyer on the spot ...... in which way it may be helpful to them at the time of 9.30 pm..... suppose a lawyer comes what about the initial procedure he can do as a lawyer in favour of them? for a labour problem come under the labour law, how they can seek a solution with police? please give your valuable suggestions on this ...................

[font=georgia]Except in cases where there is a law and order problem that arose due to labour unrest, the police have no role to play. It is a shame that today the police are allowed to interfere in all cases, irrespective of its nature. There are umpteen number of cases where police personnel interfere in pure civil disputes. It is also a fact that lawyers too throng police station for these issues for makng quick money. Unless people are educated and there is accountability for police for interfering in such matters these things will continue[/font]

Dear Mr.Ravkumarcombi,

I too feel that police have no role in civil disputes. But there is no mechanism to control this.

By the way I think you can make private enquiries about a member by sending him a message.

Hi Ravi,

It seems i have already replied the question in another topic. still for brevity, i might just state here that the matter may be a civil dispute, however, even in civil disputes there is a tinch of criminal offences committed, like criminal misappropriation of property, criminal breach of trust, etc.

The role of an advocate here is to see that the client gets relief / justice and adequate punishment is metted to the offender.

In your case, by a clever drafting, inorder to coerce the other party to perform his part of the obligation, a criminal case can be made out, hence the call for a lawyer.
