Motor accident

Owner of car had taken policy as private car policy...
owner of the car had given that car to his driver...
on the day of accident the car was used as passenger vehicle by driver...

is it breach of condition??

If the employee used it other than for a specified purpose without the consent of the owner, the status is in dispute.. We come across such incidents where interstate Goods vehicles allow passengers to travel in cabins. But for third party insurance, I do not think that makes any difference with the insurance companies.
