please help us and tell how to take Injunction orders

 

Plaintiff s lawyer failed a suite on 12-11-10 for

1)      Declaration of Title

2)      Consecution Injunction against 1st Respondent

3)      Permanent Injunction against 2nd Respondent

 

 Due to lawyers boycott in Andra Prades, Kadapa dist

he is not presenting himself before judge, because of boycott

 

      Our Lawyer has submitted all documents of our land and

      we got the suit date on 18-01-2011, but

Our Lawyers not able to take, Consecution Injunction against 1st Respondent

and Permanent Injunction against 2nd Respondent

 

please help us and tell how to take Injunction orders

If interim injunction has already granted as exparte while the suit is heard, you have to file petition u/s 151 to extend the same.

If there is no injunction order granted only notice issued you have wait until the respondents file counter and then argue the matter on merits.

the injunction application should be deal with in 30 days, so on the date of hearing, if advocate's boycott, you may appear through party in person, where you emerged the respondent side to file counter on regards i.a., if you able you may argue the same on same day itself

you must be knowing as to whether ad-interim injunction was granted or not on the day when suit was numbered.  if  not granted on that day urgent notice have been ordered and in such case you have wait till appearance of teh respondents.
