Presumption under sec. 113-a of evidence act

Acquittal from the  offence under Sec. 498-A of I.P.C. - Acquittal will bar prosecution to use  Presumption under Sec. 113-A of Evidence Act, to prove abetment to Suicide

 

Harassment is something of a lesser degree than cruelty, and the mere fact that there is a finding of harassment would not lead to the conclusion that there is "abetment of suicide". Acquittal for 498-A will bar Prosecution to use 113-A Presumption to prove abetment to Suicide
