Property transfer

Hello experts.... Need your advice. This is regarding a property which is in my mother's name(self acquired)she is now no more.She passed away about 2 yrs back, without a will,I am her only daughter. My father passed away abt 15 yrs back.Now need to transfer the property to my name.... What is the procedure? Would I require a legal heir certificate....? Are these certificates still issued at the tahsildar office? I am a resident of Bangalore and the said property is also in Bangalore.

Go for succession certificate. Then mutate that property in your name.

The forms/procedure/process for such simple matters of inheritance; 'Intestate Sucession' is available in O/o Authority under whose jurisdiction property falls say;MC.

Death Certificate, Legal heir certificate/or affifdavit or attestation by say; local Municiple Corporation Councillor might be accepted and ownership may be transferred i name of Legal heirs.

Legal heir certificate is issued by O/o Tehsildar.

Obtain the forms and complete the procedure. 

Succession Certificate may not be required.

Noted that you are HIndu.

 

Since husband (your father) of deceased Lady (your mother) died before his wife (your mother) the surviving sons and daughters ( i.e. you and including you) have 1st right.

Go thru the form and complete the fomalities.

As per existing rules  legal heir certificate from O/o Tehsildar may not be asked in form.

Check the existing LOCAL form, rules....
