My father acquired property of the house in his name after the passing of my grandparents. My grandparents also split up the farmlands they had into 3 parts for 3 of their sons as well. One of the sons gave his share to my father when he left the country but never fully transferred the property legally in my fathers name. Now the oldest son wants the property from my father but it is not legally in his name to give to him. My other uncle is not cooperating in legally transferring the property in either brother's names and is sticking to the statement that he has already given it to my father and is no longer the owner of the property. My father is not interested in keeping any of the property even the property that is in his name. What is the process in which he can transfer the property over to the other two brothers? What does he need to include in the legal papers that give away not only the property that is in his name but also the property which my uncle is the legal owner of? Please advise as to what can be done?
